Musicale™ is a service operated by Intelli-Net LLC.
1. Introduction
Musicale™ (“Musicale,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy describes how we collect, use, disclose, and protect information when you use our website, applications, and services (collectively, the “Service”). By using the Service, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Service.
2. Information We Collect
We may collect the following categories of information:
- Account and profile information: When you register or sign in, we may collect name, email address, and profile type (e.g., music lover, musician, venue). We sign you in using a one-time code sent to your email; we do not use or store traditional account passwords. If you create a musician or venue profile, we may collect bio, photos, location (city, region, country), genre, and similar details you provide.
- Location information: To provide “events near you,” distance filters, and other location-based features, we may collect or use:
- Browser or device geolocation (with your permission)
- City or ZIP code you enter for location lookup
- Coordinates or location derived from your profile or session (e.g., default search radius or city stored in preferences)
- Preferences and usage: Search and filter preferences (e.g., distance radius, genre selections, date ranges) may be stored in your session or, when you are logged in, associated with your account to personalize the Service.
- Favorites and saved content: If you save musicians, venues, or events to your favorites, we store those associations to display and manage your list.
- Content you submit: Event listings, venue information, artist bios, images, and other content you upload or submit through the Service.
- Device and usage data: Log data (e.g., IP address, browser type, pages visited), and similar technical information that helps us operate, secure, and improve the Service.
- Cookies and similar technologies: We may use cookies, local storage, or similar technologies for authentication, preferences, and analytics as described in our Cookie Notice.
3. How We Use Your Information
We use the information we collect to:
- Provide, maintain, and improve the Service (e.g., show events, venues, and musicians; personalize results by location and preferences)
- Create and manage your account; store and honor your preferences (e.g., default distance, genres) across sessions when you are logged in
- Display your favorites and saved content; allow you to manage musician or venue profiles and event listings
- Process transactions and communicate with you about your account, subscriptions, or the Service
- Send you service-related communications and, where permitted by law and in accordance with your preferences, marketing communications
- Detect, prevent, and address fraud, abuse, or security issues; comply with legal obligations
- Analyze usage and trends to improve the Service and user experience
Location data is used to power distance-based search, “find me” and city/ZIP lookup features, and to show relevant events and venues. When you are not logged in, location and filter preferences may be stored in your browser session only; when logged in, we may associate certain preferences with your account as described in the Service.
4. Sharing and Disclosure
We may share your information in the following circumstances:
- Public and semi-public content: Content you choose to make public (e.g., musician or venue profiles, event listings) may be visible to other users and the public.
- Service providers: We may share information with vendors who help us operate the Service (e.g., hosting, analytics, email, payment processing), subject to contractual obligations that limit their use of your information to providing services on our behalf.
- Partners and sponsored content: The Service may integrate with or display content from third parties (e.g., event or ticket partners). When you interact with external links or services, their privacy policies apply. We do not sell your personal information to third parties for their own marketing purposes.
- Legal and safety: We may disclose information if required by law, to protect our or others’ rights or safety, or in connection with a merger, sale, or other transfer of assets.
5. Data Retention
We retain your information for as long as your account is active or as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements. You may request deletion of your account and associated data as described in “Your Rights” below. Some information may remain in backup or anonymized form after deletion.
6. Security
We use reasonable technical and organizational measures to help protect your information against unauthorized access, loss, or alteration. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.
7. Your Rights and Choices
Depending on where you live, you may have the right to:
- Access and portability: Request a copy of the personal information we hold about you.
- Correction: Update or correct inaccurate information (e.g., through your account or profile settings).
- Deletion: Request deletion of your personal information and account, subject to legal or legitimate retention needs.
- Opt-out and restrictions: Opt out of marketing communications; in some jurisdictions, object to or restrict certain processing.
You can manage many preferences (e.g., profile information, favorites, saved content) directly within the Service. To exercise other rights or ask questions, contact us as set out in the Contact section. If you are in the European Economic Area or the UK, you may also have the right to lodge a complaint with a supervisory authority.
8. Children
The Service is not directed to children under 13 (or higher age where required). We do not knowingly collect personal information from children. If you believe we have collected information from a child, please contact us and we will take steps to delete it.
9. International Transfers
Your information may be processed in the United States or other countries where we or our service providers operate. By using the Service, you consent to the transfer of your information to countries that may have different data protection laws. Where required, we implement appropriate safeguards (e.g., standard contractual clauses) for such transfers.
10. Changes to This Policy
We may update this Privacy Policy from time to time. We will post the updated policy on the Service and update the “Last updated” date. Material changes may be communicated via the Service or by email where appropriate. Your continued use of the Service after the effective date constitutes acceptance of the revised Privacy Policy.
